To All To Whom these Presents shall come or whom the same may in any way concern, Greeting: MORRIS ROSENBERG Deputy Attorney General A Proclamation Whereas, by Order in Council P.C. 2000-1351 of August 23, 2000, the Governor in Council declared that, in accordance with Article XVIII of the Interim Agreement on Social Security between the Government of Canada and the Government of Israel, signed on April 9, 2000, the Agreement shall enter into force on the first day of the fourth month following the month in which each Party shall have received from the other Party written notification that it has complied with all requirements for the entry into force of the Agreement; Whereas that Order in Council was laid before Parliament on October 16, 2000 and, as Parliament was prorogued before the Order was tabled for 30 sitting days, as required under the provisions of the Old Age Security Act , the Order was again laid before Parliament on February 12, 2001; Whereas, before the twentieth sitting day after the Order had been laid before Parliament, no motion for the consideration of either House to the effect that the Order be revoked was filed with the Speaker of the appropriate House; Whereas, pursuant to subsection 42(2) of the Old Age Security Act , the Order came into force on the thirtieth sitting day after it had again been laid before Parliament, being April 2, 2001; Whereas the exchange of written notification was completed on May 27, 2003; Whereas the Agreement shall enter into force on the first day of the fourth month following the month in which the Parties exchanged written notices, being September 1, 2003; And whereas, by Order in Council P.C. 2003-1226 of August 13, 2003, the Governor in Council directed that a proclamation do issue giving notice that the Interim Agreement on Social Security between the Government of Canada and the Government of Israel, a copy of which is annexed to this Order, shall enter into force on September 1, 2003; Now Know You that We, by and with the advice of Our Privy Council for Canada, do by this Our Proclamation give notice that the Interim Agreement on Social Security between the Government of Canada and the Government of Israel, signed on April 9, 2000, a copy of which is annexed hereto, shall enter into force on September 1, 2003. Of All Which Our Loving Subjects and all others whom these Presents may concern are hereby required to take notice and to govern themselves accordingly. His Excellency the Governor General in Council, considering that it is in the public interest to do so, on the recommendation of the Minister of National Revenue, pursuant to subsection 23(2) Footnote * of the Financial Administration Act , hereby remits to each taxpayer, other than a promoter, who has delivered or delivers to the Minister a timely and duly executed agreement letter (referred to in the details of the settlement project regarding general partnerships used as SR & ED tax shelters issued by the Minister on June 30, 1995) accepted by the Minister, amounts payable under the Income Tax Act by the taxpayer equal to (1) the difference between (a) 50% of the product of each payment made before executing the agreement on account of the tax liability resulting from adjustments made by the Minister to the taxpayer’s claim in respect of the tax shelter and the prescribed rate of interest for income tax refunds, for the period from the date of the payment to the date of the assessment of the tax liability made as a result of the agreement, compounded daily, and (b) refund interest in respect of any such payment, (2) 50% of the product of that difference and that rate, for the period from the said date of assessment to the date this Order is implemented, so compounded, and (3) amounts that would not be payable if there were no such refund interest or if this Order were not made.
